1. About these Terms

These Terms of Use govern your use of us.franchmonsters.com (the “Site”), operated by FOP Tovkach Maksym Pavlovych, sole proprietor, Kyiv, Ukraine (“we,” “us”).

By using the Site, you agree to these Terms. If you do not agree, please stop using the Site.

2. What the Site is

The Site is an independent franchise catalog. We publish information about franchises for entrepreneurs who are looking for one, and we offer franchisors a listing in the catalog.

We are not a franchisor, a franchise broker or a representative of any brand in the catalog. The brands in the catalog are not affiliated with the Site and have not approved or endorsed their pages, unless a page says otherwise. Brand names and logos shown on the Site are trademarks of their respective owners; photos belong to their respective owners.

3. No offer to sell a franchise

Nothing on the Site is an offer to sell a franchise. Only the franchisor makes an offer to sell its franchise, through its own Franchise Disclosure Document (FDD).

4. Information in listings

Figures in listings are taken from the franchisor’s FDD and the franchisor’s official pages as of the date shown on the listing, and they may be out of date. Before making any decision, check the current figures with the franchisor and in its current FDD. Information about the financial performance of a franchise, if the franchisor provides any, is set out in Item 19 of its FDD.

The Site does not provide legal, tax or financial advice. It does not promise any income or profit, or that you will recover your investment.

5. Listing service for franchisors

Franchisors can list their franchise in the catalog for an annual listing fee:

• Annual listing fee: $1,399 — a listing in the catalog for 12 months

To apply, submit a request through the form on the Site. A manager will contact you to clarify the details, and our editorial team then reviews the franchise. The fee is paid only after the editorial team approves the franchise for publication; if the franchise is not approved, no fee is charged. The listing is published after payment is confirmed.

The price may change; the current price is always shown on the /sell page.

6. Limits of our responsibility

The Site is an information resource. We are not a party to any agreement between a franchisor and a franchisee, and we are not responsible for:

• the accuracy of information provided or published by franchisors;
• the outcome of agreements between a franchisor and a franchisee;
• losses arising from the use of information on the Site.

We try to keep the Site running without interruption, but we cannot promise that it will always be available.

7. Your obligations

When using the Site, you agree to:

• provide accurate information when you fill out forms;
• not submit false, misleading or unlawful information;
• not use the Site for unlawful purposes;
• not infringe the intellectual property rights of others.

8. Intellectual property

Brand names, logos and photos in listings belong to their owners, as described in section 2. The Site’s own texts, design and structure belong to us or are used on a lawful basis. You may not copy or reproduce them without our written permission.

9. Privacy

We handle personal information as described in our Privacy Policy, published at /privacy.

10. Changes to these Terms

We may change these Terms. The current version is always published on this page with its effective date. If you continue to use the Site after a change, you accept the updated Terms.
