About the franchise

Quality Is Our Recipe, LLC became the franchisor of Wendy's restaurants in the USA on June 1, 2015, and its ultimate corporate parent is The Wendy's Company. "As of December 28, 2025, there were 5,969 Wendy's Restaurants operating in the United States and 1,428 Wendy's Restaurants operating outside the United States (including U.S. territories). Of the total Restaurants in the United States, 5,546 were franchised and 423 were company operated," per the 2026 FDD (Item 1). Item 20 of the FDD, as amended May 29, 2026, adds that Exhibit R separately identifies the 115 franchisees that closed restaurants during fiscal year 2026 before that document's issuance date, "most of which were closed as part of our Project Fresh initiative."

"As we plan to build more traditional restaurants, we're seeking new franchise owners to supercharge our efforts, transform markets, and unlock new potential," Wendy's says on its Franchise Opportunities page. Its Becoming a Franchisee page describes the experience and capital Wendy's expects from new franchise applicants, and its FAQs page lists different capital minimums.

You select the location for a new restaurant, Wendy's says on its FAQs page; its real estate representatives can help with site selection, and Wendy's must approve the location and building plans. Generally, Wendy's does not own and lease the restaurant premises to you unless you join its Build-to-Suit program (FDD Item 11).

Item 19 of the 2026 FDD has three tables for fiscal year 2025: average annual Gross Sales of U.S. company and franchise restaurants, the same for non-traditional franchise restaurants only, and a P&L breakout for traditional company-owned restaurants. Item 19 adds: "Some outlets have earned the amounts reflected in this item. Your individual results may vary."

Franchise agreement

The Franchise Agreement runs 20 to 25 years from the restaurant's opening date, depending on your lease term. You can renew it for 10 years if you are in good standing and meet the renewal conditions (FDD Item 17).

Frequently asked questions

If you pay cash for all expenditures, Item 7 of Wendy's FDD puts the total estimated initial investment from $1,580,457. The total includes the $50,000 Initial Technical Assistance Fee but not real property: Item 7 lists real property separately, as "Varies," because real estate costs vary as negotiated with the seller or landlord and cannot be predicted. The building and site construction estimates are based on the approved budgets for 34 of the 35 most recent company-led projects for franchisee-operated restaurants and are net of a landlord-provided tenant improvement allowance; they do not reflect the construction costs of a drive-thru-only location or of certain types of non-traditional locations. The estimated amounts also leave out royalties, advertising fees, food and paper expenses, and insurance premiums (FDD Item 7).

Wendy's calls it the Technical Assistance Fee. Item 5 of the FDD states that "you must pay a Technical Assistance Fee of $50,000 for each Wendy's Restaurant at the time the Franchise Agreement is executed," and the Item 7 table counts it in the total as the "Initial Technical Assistance Fee" of $50,000. In limited cases, Wendy's may charge a modified fee or waive it; a $25,000 fee generally applies to non-traditional sites.

Besides the $50,000 Technical Assistance Fee, Item 5 of the FDD requires a $5,000 Training Fee, which Wendy's may waive if you are already part of the Wendy's system, and reimbursement of the $500 cost of each background investigation. Item 7 estimates grand opening advertising for a standard restaurant at $10,000; it is part of the pre-opening line of the total, together with the Training Fee, opening inventory and supplies, and additional prepaid expenses. If you choose Wendy's optional programs for a new restaurant, their fees are extra: under the Franchise Development Program (FDP), a $35,000 Project Fee for project management; under the Real Estate Procurement Program (REPP), a $12,500 Real Estate Services Fee, a $17,500 Transaction Services Fee, and a $35,000 Project Fee (FDD Item 5). Under the Build-to-Suit program, you pay a $12,500 Real Estate Services Fee, a $40,000 Real Estate Development Services Fee, and a $17,500 Transaction Services Fee, the last two each plus applicable taxes, as well as sublease rent that includes a lease administration fee of at least $6,000 per year (FDD Items 5 and 6).

Two of Wendy's franchising pages list different minimums. On its Becoming a Franchisee page, Wendy's lists a minimum of $5,000,000 in net worth and $2,000,000 in liquidity for all new franchise applicants and notes that net worth requirements vary for international markets and according to market opportunity. Its FAQs page lists a minimum net worth of at least $1,000,000 in the USA and Canada and minimum liquid assets of at least $500,000. The FDD does not state these amounts, so confirm them with Wendy's before you apply.

The royalty depends on the type of restaurant and development program: 4% of Gross Sales for a traditional/Groundbreaker Restaurant, 5% for a restaurant developed under a previously executed Pacesetter Development Agreement, and 6% for a restaurant on a military base or one developed or acquired under the Build-to-Suit Program (FDD Item 6). Besides the royalty, the Franchise Agreement requires you to spend on or contribute for advertising and promotion each month an amount equal to 4% of the restaurant's previous month's Gross Sales (the Advertising Contribution); Wendy's may raise it to a maximum of 5% only after an affirmative vote of 75% or more of all Wendy's restaurants in the USA (Franchise Agreement, Section 5.3). The Item 6 table lists national advertising as a range of percentages of Gross Sales and local and regional advertising at 0.50% of Gross Sales. For 2026 and 2027, after a WNAP vote, franchisees must contribute 4.0% of Gross Sales to The Wendy's National Advertising Program, Inc. (WNAP) and contribute or spend a minimum of 0.0% of Gross Sales on local advertising and promotion (2026 FDD, Item 6, note 5). A local or regional advertising cooperative may vote for a rate that takes the total Advertising Contribution above 4% (FDD Item 6, note 6). Item 6 lists the royalty and both advertising fees as due on the 15th day of the month; under Item 11, members of an advertising cooperative submit their contributions to it on or before the 20th day of each month.

Each restaurant pays Wendy's affiliate WETECH a Technology Fee for the technology suite required at the restaurant, billed in quarterly installments: $14,200 a year for a newly built restaurant, lowered by $1,000 a year if the restaurant uses the NCR/Dumac HelpDesk instead of Wendy's HelpDesk; the fee is evaluated annually and may increase or decrease (FDD Items 1 and 6). Item 6 also lists a Customer Care fee of $95 per restaurant per month, paid quarterly, upon invoice, and, in states with an Extended Producer Responsibility (EPR) program, an EPR fee assessed by the state based on the amount of packaging products sold. Item 6 estimates the cyber insurance policy premium at $800 per restaurant, paid quarterly upon invoice; the amount may change annually, depending on overall policy premiums, and within a policy period, depending on the total number of restaurants in the system. Under Item 11, every restaurant must take part in the Wendy's gift card program, for which franchisees pay a third-party vendor a monthly fee of $8.00 per restaurant, effective June 30, 2026; you pay 2.9% on every mobile pay redemption when a customer uses funds from the Wendy's App Digital Wallet for an in-restaurant purchase; and the annual license for WeLearn, Wendy's online training system, is currently $160 per restaurant, plus local taxes. Item 11 also lists ongoing annual maintenance and support costs for required technology, based on prices of Wendy's-approved suppliers, such as from $1,000 a year for the POS system and from $600 a year for headsets and timers.

Yes. Item 17 of the FDD provides a 10-year renewal term if you are in good standing and meet the renewal conditions. These include giving written notice, being current on all obligations, showing your right to occupy the approved location, signing the then-current renewal agreement and a general release, and paying a renewal fee; you must also meet certain remodeling, equipment, and operational standards. On renewal, you may be asked to sign a new Franchise Agreement with materially different terms, such as different fees.
